OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.  A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

 

The VISITBRITAIN SHAKESPEARE SWEEPSTAKES (“Sweepstakes”) starts at 12:01 am Eastern Time (“ET”) on July 18, 2016 and ends at 11:59 pm (ET) on December 31, 2016 (“Online Entry Period”) for entry at the Entry Site (as defined below) The sponsor of this Sweepstakes is British Tourist Authority (operating as VisitBritain) a statutory body incorporated under the Development of Tourism Act 1969 with its office address at Sanctuary Buildings, 20 Great Smith Street, London SW1P (the “Sponsor”).  The Sweepstakes shall be subject to these Official Rules, and by entering, all participants acknowledge that they have read these Official Rules and agree to be bound by the terms and conditions herein.

 

ELIGIBILITY:  THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE FORTY-EIGHT (48) CONTIGUOUS CONTINENTAL UNITED STATES (VOID IN ALASKA AND HAWAII) AND THE DISTRICT OF COLUMBIA (COLLECTIVELY THE “ELIGIBILITY AREA”), WHO AS OF THE DATE OF THEIR ENTRY INTO THE SWEEPSTAKES ARE EIGHTEEN (18) YEARS OF AGE OR OLDER.  Employees of the Sponsor, American Airlines Group, Inc. (“American Airlines”), Shakespeare’s England, West Coast Marketing, a division of The Susquehanna Hat Co. (“West Coast Marketing”) their respective parent company, affiliates, subsidiaries, and related companies and agencies (all collectively to be referred to herein as the “Sweepstakes Entities”), and their immediate families (defined as parents, grandparents, children, siblings and spouse and their respective spouses, regardless of where they reside) and those living in the household of same, whether or not related, are not eligible to enter or win.  An individual at least eighteen (18) years of age, but considered a minor in his/her legal jurisdiction of residency (“Minor”) that wins a prize, will be awarded the prize in the name of Minor’s parent or legal guardian.  An Entrant who is a Minor must have permission from Entrant’s parent or legal guardian prior to entering this Sweepstakes, and such entry shall be deemed submitted by an Entrant’s parent or legal guardian and shall be treated as if an Entrant’s parent or legal guardian had made such entry.  By entering this Sweepstakes, entrants agree to abide by all terms of these Official Rules.  All Federal, state and local rules and regulations apply. Void outside the Eligibility Area and where prohibited or restricted by law.   

 

HOW TO ENTER THE SWEEPSTAKES: There is one (1) way to enter the Sweepstakes; online via the Entry Site; with the method of entry detailed herein:

To enter the Sweepstakes online via the Entry Site, log on to the web site www.visitbritain.com/shakespearelives (“Entry Site”) during the Online Entry Period. Follow the directions for entry in the Sweepstakes; providing your first and last name, zip code, country, daytime telephone number, email address, the answer to the trivia question(s) asked, acknowledge that you are 18 years of age or older and accept the terms and conditions.  Note: correct answer to the previously mentioned question is required for entry and the answer is available at the Entry Site. Once you have completed the entry process, click the “Submit” button to submit your completed entry (“Online Entry”). Note: to unsubscribe to VisitBritain’s Newsletter simply follow the directions, clicking on the unsubscribe link found on any newsletter received by email.

Online Entry may be referred to herein individually as an “Entry” and collectively as “Entries” and individuals submitting such Entry referred to herein as an “Entrant”.

 

ONLY ONE (1) ENTRY PER PERSON/EMAIL ADDRESS/HOUSEHOLD WILL BE ACCEPTED FOR THIS SWEEPSTAKES.

 

By participating in the Sweepstakes, Entrants agree to release, indemnify and hold harmless the Sweepstakes Entities, and all their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies, and each of their respective agents, representatives, officers, directors, shareholders, and employees (collectively, “Released Parties”) from and against any injuries, losses, damages, claims, actions, or liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or non-use of any prize or parts thereof that may be awarded including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.  Winner releases the Released Parties from any and all liability and responsibility with respect to a prize (including any property loss, damage, personal injury or death).  

 

Released Parties are not responsible for any incorrect or inaccurate Entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, providers, or software, including any injury or damage to participant's or any other person's computer or internet device relating to or resulting from participation in this Sweepstakes; inability to connect to any web page including but not limited to the Entry Site, theft, tampering, destruction, or unauthorized access to, or alteration of Entries; Entries that are processed late or incorrectly or are incomplete or lost due to computer, internet access device or electronic malfunction or traffic congestion on the Internet or on any web site and/or telephone lines; printing or other typographical error in any Sweepstakes related materials; and any Entries which are processed, reported or transmitted late, lost, incomplete, misdirected, stolen, undelivered, mutilated, illegible, garbled, fail to enter into the processing system, postage-due or any combination thereof; or theft or destruction or corruption of Entries.  Proof of submitting an Entry is not considered proof of delivery or receipt.  Illegible, incomplete and duplicate Entries will be disqualified.  All Entries become property of Sponsor and will not be acknowledged or returned.  False and/or deceptive Entries or acts shall render Entrants ineligible.

 

Any Entry information collected from the Sweepstakes shall be used only in a manner consistent with these Official Rules, any consent given at time of Entry and VisitBritain’s Privacy Policy accessible at the Entry Site.     

 

WINNER SELECTION:  One (1) potential Grand Prize (defined below) winner will be selected in a random drawing from among all eligible entries on or about January 5, 2017 by representatives of the Sponsor, whose decisions are and shall be final and binding in all matters relating to this Sweepstakes.  Winner will be notified by email and/or telephone within fourteen (14) days of random drawing.

 

Winner (or winner’s parent or legal guardian if winner is a Minor) will be required to execute and return a notarized Affidavit of Eligibility/Release of Liability and where legal, a Publicity Release form and a completed IRS #W-9 form within seven (7) days of date of issuance.  Winner’s travel companion (or winner if travel companion is Minor child or ward of winner) will also be required to execute and return a Release of Liability within this same seven (7) day deadline.  Failure to respond to the winner notification as detailed above or return all required forms within the stated time period, or to comply with any other provision herein, may result in the winner being disqualified and an alternate winner may be selected at Sponsor’s sole discretion.  If a prize notification or prize is returned as undeliverable for any reason, the prize may be awarded to an alternate winner at Sponsor’s sole discretion.  Once all required documents have been received, correctly completed and executed, such winner shall be declared the “Grand Prize Winner” of the Sweepstakes. Prize is not transferable, assignable, or redeemable for cash. No substitution for the prize by the Grand Prize Winner will be allowed.  If necessary, due to unavailability of the prize for any reason, a prize of comparable value will be awarded at the sole discretion of the Sponsor.  A Minor will not be allowed to participate in any portion of Grand Prize without being accompanied by his/her parent or legal guardian that executed all required documents on said Minor’s behalf.

 

All Federal, state and local tax liabilities, if any, are the responsibility of the Grand Prize Winner.  Acceptance of the prize constitutes permission (except where prohibited) for Sponsor and/or its affiliates to use of Grand Prize Winner’s name, statements, photograph, image and biography for publicity purposes without any limitation or additional compensation.

 

GRAND PRIZE: (one [1] prize (“Grand Prize”) is available to Grand Prize Winner): The Grand Prize shall consist of a trip for Grand Prize winner and one (1) travel companion (“Travel Companion”) to Stratford-upon-Avon, UK ("Trip").  The Trip includes the following: (i) roundtrip (“R/T”) economy class airfare for two (2) from the major American Airlines-service city airport nearest the Grand Prize Winner's residence and within the Eligibility Area to Birmingham, UK (“Birmingham”) airport; two (2) R/T train tickets between Birmingham and Stratford-upon-Avon and between Stratford-upon-Avon and Warwick; (ii) four (4) consecutive nights hotel (or similar) accommodations (single standard room, double occupancy; room and tax only) (“Accommodations”) including breakfast daily (as determined by Sponsor) in Stratford-upon-Avon (awarded specifically as two (2) nights) and Warwick (awarded specifically as two (2) nights); (iii) guided walking tour (“Tour”) in Stratford-upon-Avon for two (2); (iv) two (2) tickets to performance (“Performance”) at the Royal Shakespeare Company, Stratford-upon-Avon (not valid on Saturdays) including backstage tour; and (v) the following sightseeing (“Sightseeing”) events: 5-House pass to Shakespeare’s birthplace for two (2);  two (2) tickets to see Shakespeare’s Schoolroom and Guildhall; two (2) tickets to Warwick Castle, two (2) tickets to Lord Leycester Hospital, two (2) tickets to Kenilworth Castle and a Tour of Cotswold. Specific elements of the Grand Prize, including but not limited to Accommodations, Tour, Sightseeing and Performance are at the sole discretion of the Sponsor or its designee(s) and subject to possible changes.  The approximate retail value ("ARV") of the Grand Prize is $4,900.  The actual value of the Grand Prize may vary depending on city of departure, date and times of travel, airfare fluctuations and Accommodation charges at the time of travel booking. Therefore, the actual value of the Grand Prize awarded may be lower or higher at the time it is fulfilled.  If Grand Prize Winner elects to travel with no Travel Companion, no additional prize element will be substituted. Any difference between actual value and stated ARV will not be awarded.    

 

TRAVEL TERMS: All travel is subject to the following restrictions and conditions:  All additional meals and ground transfers, gratuities, excursions, insurance, fees, surcharges, service charges or passenger facility charges, incidentals, departure and airport taxes, passport fees, visa fees, security fees, insurance, gasoline and any other expenses not specified herein are the sole responsibility of the Grand Prize winner and his or her travel companion.  All travel arrangements are to be administered by Sponsor or its designee.   Winner must give a minimum of forty-five (45) days advance notice of desired departure. All travel and elements of the Grand Prize are subject to availability, blackout dates, fare restrictions and all applicable restrictions as outlined in prize winner notification letter. Travel is subject to availability of "T" class at time of ticketing. All travel must be taken and completed by August 31, 2017.

Air transportation will be awarded as an Award letter from American Airlines, subject to the following:

 Award letter is void if sold, purchased or bartered.

 Award letters/tickets are non-transferable.  Award letters are not replaceable if lost or stolen and cannot be extended or renewed.

 A Processing Fee will be charged to reinstate travel not cancelled prior to ticketed departure (based on the class of service).  

 Passengers are not eligible for American AAdvantage mileage credit or any other promotional benefit that American Airlines may offer.

 No AAdvantage or Electronic Upgrades Allowed.

 Travel is not valid on AA codeshare flights.

 Travel must be via the most direct American Airlines/American Eagle routing. Unnecessary and circuitous routings, connecting points, and/or segments are prohibited.

 Maximum one stopover allowed on applicable routing.  $100.00 USD Per Person Stopover Fee Applies.

 Fees, taxes, surcharges, and service charges are the responsibility of the passenger, including checked baggage fees and other airport related charges.

 All Fees are payable via credit card and are NON-REFUNDABLE.

 One credit card per booking and must be in the name of one of the passengers or be a corporate card.

 American Airlines reserves the right to change blackout dates, embargo free travel, and change policies without advance notice.

 

Travel is subject to capacity controls, availability, blackout dates and certain other restrictions, which may include a Saturday night stay, all of which are subject to change. If winner is unable to travel by date indicated, prize will be forfeited.

Winner and Travel Companion will be required to travel on identical itineraries including the same departure date, destination and return date.   Winner and Travel Companion will be required to provide a valid passport at time of travel as required by United States and United Kingdom immigration authorities.   No changes will be made to travel details once any element(s) of the travel arrangements have been booked. No frequent flier miles will be earned on any element of prize travel.  Prize conditions may be added or modified by Sponsor.  Released Parties are not responsible for any changes of any element of Grand Prize travel and Released Parties are not liable for any expenses incurred as a consequence of flight cancellation or flight delays.  Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates.  Grand Prize Winner must have/present at least one major credit card in good standing in order to check into Accommodations and accept car rental. 

No stopovers are permitted on tickets issued as a prize except as discussed herein; if an unscheduled stopover occurs, the prize will terminate and full fare will be charged from the stopover point for the remaining trip segments, including the return. Once Accommodations and flight arrangements have been confirmed, no changes will be allowed except by Sponsor.  An unclaimed and/or unused Grand Prize travel package will remain the property of Sponsor or its designee.

Prize is non-transferable, assignable and has no cash value. No prize substitution or cash redemption allowed by Winner. Sponsor reserves the right to substitute prize of comparable value if advertised prize becomes unavailable.  Prize may not be sold, bartered or exchanged by Winner.  Prize is provided "as is" and without any warranty of any kind.  Odds of winning depend on total number of eligible entries.

 

FORCE MAJEURE: Released Parties shall not be liable to the Grand Prize Winner or any other person for failure to supply the Grand Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, network or computer problems, internet problems, hacking, computer viruses, unauthorized computer access, tampering, or any other cause beyond Sponsor’s sole control.  Released Parties shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carrier(s), Accommodations, or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same.  Released Parties’ legal responsibility for loss or damage to baggage shall be strictly governed by the Warsaw Convention and the other applicable conditions of carriage set forth on the passengers’ tickets.

 

GENERAL:  If for any reason this Sweepstakes is not capable of running as planned, or if this Sweepstakes (or any portion(s) thereof) becomes corrupted or does not allow the proper playing of the Sweepstakes and processing of Entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by Entrants, fraud, technical failures, or any other causes, in the Sponsor’s sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Sweepstakes or any portion thereof.  In the event this Sweepstakes is cancelled, and if possible, the Sponsor will conduct a random drawing to award the Grand Prize from among all eligible, non-suspect Entries received prior to the time of the action or event warranting such cancellation.  ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  If a dispute arises about who submitted an Entry the Entry will be deemed submitted by the authorized account holder of the email address entered at the time of Entry. The authorized account holder is deemed the natural person who is assigned to an email address by an Internet service provider.  The winner may be requested to provide Sponsor with proof that the winner is the authorized account holder of the email address associated with the winning Entry and that all eligibility requirements are met.   

The use of any device or software to automate the Entry process is prohibited.

NOTE: Entry must be made by the Entrant only as detailed above. Entries made by any other individual or any entity, and/or originating at any other web site, including, but not limited to, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes.  Entries generated by a script, computer programs, macro, programmed, robotic or other automated means are void and may be disqualified.   The use of any device or software to automate the Entry process is prohibited. Entries, mail or other Sweepstakes materials that are incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late, misdirected, postage due, deceptive, in greater quantity than the limit stated above or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsor’s sole and absolute discretion.

 

CHOICE OF LAW / LIMITATION OF LIABILITYAll issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of Entrants and Released Parties in connection with the Sweepstakes will be governed by and construed in accordance with the internal laws of the State of New York, USA. 

BY ENTERING THE SWEEPSTAKES, ENTRANT (OR ENTRANT’S PARENT OR LEGAL GUARDIAN IF ENTRANT IS A MINOR) AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED FIFTY DOLLARS ($50.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT-OF-POCKET EXPENSES NOT TO EXCEED FIFTY DOLLARS ($50.00), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF.  SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. 

 

MISCELLAENOUS: The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.  In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.  Entrants agree to waive any rights to claim ambiguity of these Official Rules.  Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of the documents or any provision hereof.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Sweepstakes-related materials, privacy policy or terms of use on the Entry Site and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control and the discrepancy will be resolved in Sponsor’s sole and absolute discretion.
