VisitBritain/VisitEngland User Generated Content Terms of Use - Social Media and Online Use

1 Introduction

1.1 The British Tourist Authority t/a VisitBritain/VisitEngland (“VisitBritain/VisitEngland”) from time to time contacts social media users to seek their permission to feature content on VisitBritain/VisitEngland social, media and online channels. These Terms of Use outlines the standards we require to be observed when VisitBritain/VisitEngland has requested your permission to use your social media content (“User Content”).

1.2 In these Terms of Use, ‘social media’ means internet-based applications which allow users to collaborate or interact socially by creating and exchanging content, such as social networks or platforms, community sites, blogs, microblogging sites, wikis, web forums, social bookmarking services and user rating services. Examples include but are not limited to Facebook, LinkedIn, Yammer, YouTube, Instagram, Twitter, Tumblr, Flickr, SlideShare, Foursquare and Pinterest. If you choose to allow us to use your User Content by replying with the hashtag #LoveGreatBritain to our usage enquiry, you agree explicitly to these Terms of Use.

1.3 VisitBritain/VisitEngland engages service providers to facilitate the collection and transmission to the social media channels of User Content. This includes but is not limited to, photographs, text, graphics, audio, video, location information, comments and other materials from social media sites, for use by VisitBritain/VisitEngland in connection with its marketing, promotional, advertising and other consumer-related activities (“VisitBritain/VisitEngland online Services”).

1.4 We reserve the right to alter these Terms of Use without advance notice by posting a revised Terms of Use. Accordingly, you should review the Terms of Use each time you grant us permission or authorisation to feature your User Content.

2 User Content License

2.1 The Licensor (“You”) hereby grants the Licensee (“VisitBritain/VisitEngland”) a worldwide, perpetual, irrevocable, royalty-free, non-exclusive right to use your User Content for the uses set out below: -

a)  Organic posts, re-shares or re-tweets; and

b)  Re-shares of temporary stories.

2.2 You grant VisitBritain/VisitEngland the right to use your username, image, likeness, descriptions of you, location or other identifying information, including but not limited to your voice, in connection with any use of your User Content.

2.3 You hereby agree and represent and warrant that (i) you are solely responsible for your User Content, (ii) you own all rights in and to your User Content and/or have obtained appropriate rights and permissions from any and all other persons and/or entities who own, manage or otherwise claim any rights with respect to such User Content, (iii) you are not under 18 years of age, (iv) VisitBritain/VisitEngland use of your User Content as described in these Terms of Use will not violate the rights, including but not limited to copyright, trademark, patent, trade secret, privacy, publicity, moral, proprietary or other rights, of any third party, or any law, rule or regulation, and (v) the User Content is not libellous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, offensive or otherwise unlawful.

2.4 In submitting your User Content to VisitBritain/VisitEngland you acknowledge that you have read and accepted VisitBritain Privacy Policy and that for any personal information submitted, you agree to the collection, use, disclosure, transfer and processing of your information in accordance with the Privacy Policy and the GDPR/ Data Protection Act 2018.

2.5 We reserve the right to remove any User Content from our websites. If you believe any content, including User Content, residing on social media or displayed or used in connection with VisitBritain/VisitEngland Services infringes any person’s or entity’s copyright, please contact DPO@visitbritain.org.

3 Miscellaneous

3.1 These Terms of Use are personal to you and may not be assigned or transferred by you for any reason whatsoever without VisitBritain/VisitEngland prior written consent; and any action or conduct in violation of the foregoing shall be void and without effect.

3.2 You agree that if VisitBritain/VisitEngland does not exercise or enforce any legal right or remedy which is contained in these Terms of Use (or which VisitBritain/VisitEngland has the benefit of under any applicable law), this will not be taken to be a formal waiver of VisitBritain/VisitEngland rights and that those rights or remedies will still be available to VisitBritain/VisitEngland.

3.3 These Terms of Use shall be construed in accordance with the laws of England and Wales, if any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use are invalid, then that provision will be removed without affecting the remaining Terms of Use. The remaining provisions of these Terms of Use will continue to be valid and enforceable.

3.4 You accept that VisitBritain/ VisitEngland may contact you about further Licensing or Influencer opportunities.

4 Acknowledgment and Declaration

In accordance with paragraph 1.2 above, should you agree to allow us to use your User Content by replying with the hashtag #LoveGreatBritain to our usage enquiry, you agree explicitly to these Terms of Use, you acknowledge that you have read and understood these Terms of Use and that you have read our Privacy Policy.
